Trusteeships Strain Purple Palace

Last week was a busy one for the Purple Palace.

On Wednesday, SEIU President Mary Kay Henry removed the top two officials at 9,000-member SEIU Nevada.

On Thursday, in Detroit, SEIU officials conducted a daylong trusteeship hearing to put SEIU Healthcare Michigan under a permanent trusteeship. In February, Henry removed the local union’s president, Marge Faville Robinson.

And on Friday, Henry imposed a trusteeship on SEIU Nevada.

Thursday’s hearing in Detroit was conducted by LaPhonza Butler, who served as the “Hearing Officer.” Butler is the President of California’s SEIU Local 2015, a longtime ally of Henry, and a nemesis of SEIU-UHW President Dave Regan.

According to a memo issued by SEIU Secretary-Treasurer Gerry Hudson on April 13, 2017 (see copy below), SEIU officials have now “substantiated” the “allegations of serious financial malpractice” at SEIU Healthcare Michigan.

Hudson’s memo reports:
Specifically, a review of the Local Union’s books and records uncovered evidence that Healthcare Michigan’s loan and paid time off/earned vacation payout policies had been abused, placing Healthcare Michigan members’ rights, benefits and interests at risk.

What actually happened?

SEIU officials are mum on the details. One possibility: local union officials artificially boosted their vacation balances, and then cashed them out. The removal of Marge Faville Robinson is an obvious clue.

Henry’s multiple trusteeships appear to be leaving her a bit shorthanded at the Palace.

In February, Henry appointed Inga Skippings (her “Chief of Staff”) as a trustee in Michigan, and more recently sent Deedee Fitzpatrick (her “Deputy Chief of Staff”) to Nevada to deal with SEIU’s imploding local union in Sin City.

Kirk Adams
Of course, Purple Palace officials -- including Tom DeBruin, Kirk Adams, Stephen Lerner and Bill Ragen -- know tons about “imploding” local unions.

Henry has not yet posted a job opening for a new “aide de camp” or Chief of Staff. But SEIU has posted one for “Director of Organizational Leadership.” The job description includes “work[ing] with officers, senior staff and local union leaders to develop innovative and impactful organizational leadership strategies…”

Hmmmm. Innovative? Impactful? How about just trying to develop a “functional” leadership strategy?

That would be a big improvement.

Top SEIU Official Jumps Ship

Kirk Adams
Here's some Purple Palace intrigue.

One of SEIU's top elected officials is jumping ship… apparently the result of tensions inside Mary Kay Henry’s leadership team.

Earlier this month, Kirk Adams -- one of SEIU’s five "Executive Vice Presidents" and the Director of SEIU's Healthcare Division -- announced he’s leaving SEIU to take a job with the "Healthcare Education Project," an organization jointly run by New York's hospital bosses and 1199 New York.

By making the move, Adams is leaving Mary Kay Henry’s team and joining up with leaders of 1199NY (including George Gresham and Gerry Hudson), who’ve reportedly been plotting to unseat Mary Kay Henry from her position atop the Purple Palace.

Adams is a longtime SEIU insider. He served as the "Chief of Staff" for both Andy Stern and Mary Kay Henry. Most recently, he’s been the Director of SEIU’s Healthcare Division, which has been failing in its efforts to organize hospital workers to join SEIU.

So what’s the "Healthcare Education Project?"

It's part of a partnership between the New York hospital industry’s Chamber of Commerce (called the "Greater New York Hospital Association" (GNYHA)) and 1199NY, a local union of SEIU. Both organizations funnel millions of dollars into the "Healthcare Education Project," which then finances political campaigns to get more taxpayer funds for the hospital industry.

A recent article in the Daily Beast describes the "Healthcare Education Project" this way:
[Former 1199NY President Dennis] Rivera and the Greater New York Hospital Association (GNYHA)… began working together almost as soon as he became president. The partnership took concrete form with the creation of the joint Healthcare Education Project, which now forms the cornerstone of New York’s “medical industrial complex”…

The article goes on to describe how Rivera built an "alliance with the state Republican Party" to pursue political deals for more money for the hospital industry.

Adams, in a recent article (Modern Healthcare: "Kirk Adams Leaving Longtime SEIU Post," September 3, 2015), describes the ‘love of partnership’ that prevails among SEIU officials:
“We actually think a partnership is the best approach in healthcare, because we think healthcare is a team concept,” Adams said.

The article notes:
During Adams' tenure at SEIU, the organization has embraced partnerships like the Healthcare Education Project and the Labor Management Partnership between Kaiser Permanente and 28 union locals. This collaborative approach has garnered SEIU a less adversarial profile than peers such as National Nurses United and the National Union of Healthcare Workers.

Of course, in California, SEIU-UHW President Dave Regan has literally given away the store through his secret partnership deal with the California Hospital Association, in which Regan agreed to gag union members from reporting patient care violations to government oversight agencies.

Stay tuned for more palace intrigue...

Leaked Memo: SEIU-UHW’s Dave Regan Wages Internal War against Mary Kay Henry and SEIU

Dave Regan’s faintly concealed anger towards SEIU President Mary Kay Henry, which is contained in a June 6 letter to long-term care workers, has now burst into the open thanks to a leaked memo.

Today, the San Francisco Business Times published this article:

“'Massive Betrayal': Leaked Memo Reveals SEIU's Internal War over Health Care Workers.”

So who’s the author of the seven-page "leaked memo"?

Dave Regan!

Here are some excerpts from the San Francisco Business Times article (the full article is below. Btw, the leaked memo has not yet surfaced publicly):
Regan said the local's leadership first officially heard about the plan to downsize UHW in January, but believes it was hatched last October and has roots in years of enmity between local and national leaders.
"We are absolutely clear this decision is malicious and undertaken with the full knowledge that the interests of California healthcare workers are being sacrificed to the political needs of Mary Kay Henry," Regan wrote. "We are ashamed and embarrassed for our Union."
The decision "marks the first time in my 25 years in SEIU (that) the union has knowingly, intentionally and willfully taken a major action that is contrary to the basic interests of the membership," Regan wrote in a highly opinionated seven-page missive obtained by the San Francisco Business Times.
"To put it bluntly," he added, "this decision is a massive betrayal of our stated principles and values.
By writing the missive, which was undated but clearly written after May 21, Regan noted that he may be violating a "gag order" by SEIU's leadership forbidding officers and staffers from speaking "candidly and completely" about the decision to wrest half of his membership away.

Another quote indicates Regan may be actively working to undermine SEIU’s efforts in California.
"The effort to win the hearts and minds of UHW homecare leaders and members will be a challenging task, given their strong attachment to their UHW identity," he wrote. "This effort will not be done in weeks or even months.”

Of course, Regan's righteous indignation is tainted by so much hypocrisy (and plain old bullsh*t) that it's hard to know where to start.

Dave Regan
Regan says SEIU’s decision "marks the first time in my 25 years in SEIU (that) the union has knowingly, intentionally and willfully taken a major action that is contrary to the basic interests of the membership."

Regan apparently has forgotten about the undemocratic and disastrous trusteeship that he himself imposed on California healthcare workers in 2009. Since parachuting into California, Regan has a eliminated the defined benefit pensions of more than 25,000 SEIU-UHW members and replaced them with 401(k)s. He's accomplished this disgusting feat by brazenly lying to workers and violating SEIU-UHW's own constitution… as he famously did to 4,000 workers at the Daughters of Charity Health System.

Today, Regan professes to feel heartfelt pain that SEIU officials are harming "the interests of California healthcare workers."

Gimme a break.

Remember, this is the same guy who, soon after parachuting into California as Andy Stern’s trustee, promptly fired several thousand democratically elected SEIU-UHW Shop Stewards and then imposed "loyalty oaths" on union members.

He reportedly directed a campaign of threats, intimidation and even violence against rank-and-file workers who favored joining another union… and even had his staff attack 85-year-old labor icon Dolores Huerta and make death threats against workers.

Mary Kay Henry
This is the same guy who liquidated SEIU-UHW members’ $4.1 million strike fund in the waning days of the trusteeship, when Regan exercised total control over the union’s finances.

This is the same guy who has refused to allow SEIU-UHW’s own Executive Board to see a copy of the secret deal he signed with the California Hospital Association, which reportedly gags workers and forfeits their right to strike.

Today, Regan passionately defends the right of workers to stay in SEIU-UHW. But in 2008-09, he aggressively backed SEIU’s effort to transfer SEIU-UHW's long-term care workers into a separate union by arguing it would be better for workers.

How much integrity can Regan claim to have when he flip-flops so violently? Not much.

Yo Dave, take a long hard look in the mirror.

'Massive betrayal': Leaked memo reveals SEIU's internal war over health care workers

Jun 17, 2015

Chris Rauber

California's largest health care union is being cut virtually in half by the Service Employees' International Union's senior leaders in Washington, D.C., a step its Oakland-based leader calls "devastating" to union members.

Dave Regan, president of the Oakland-based United Healthcare Workers' West local, which currently represents about 150,000 workers in the Golden State, said SEIU President Mary Kay Henry announced the move May 21. It will slice 70,000 home care workers from UHW and transfer them to another SEIU local, leaving about 80,000 hospital and clinic service workers in the rump UHW local.

"I want to make it clear that I have offered my thoughts not in my capacity as the President of UHW," he wrote, "but rather in my capacity as an individual member of SEIU, who is protected by the SEIU Constitution."

Officials at UHW didn't immediately respond to requests for comment. But SEIU, which boasts 2 million members and 150 locals nationwide, provided a statement from Mary Kay Henry on Wednesday afternoon.

Henry's response focused on the need for good long-term-care jobs, without delving into Regan's allegations. "That's why SEIU has begun the process of uniting all long-term care members in California into one strong union with one clear goal," she said, "winning $15 an hour and a union for everyone in the state who provides care and support to seniors and people with disabilities."

The newly chartered Local 2015 will have more than 280,000 members, Henry said, making it the largest such union local in the nation.

Another SEIU memo, this one reportedly written April 14 by International Executive Vice President Kirk Adams, confirms that creation of the new long-term-care local in California is starting this month, and involves shifting more than 200,000 SEIU workers from their current locals to a single California unit focusing on nursing home and home care.

It also suggests that the fight between UHW and the national leadership will have extensive fallout.

"The effort to win the hearts and minds of UHW homecare leaders and members will be a challenging task, given their strong attachment to their UHW identity," he wrote. "This effort will not be done in weeks or even months.”

A long-brewing battle

Regan said the local's leadership first officially heard about the plan to downsize UHW in January, but believes it was hatched last October and has roots in years of enmity between local and national leaders.

"We are absolutely clear this decision is malicious and undertaken with the full knowledge that the interests of California healthcare workers are being sacrificed to the political needs of Mary Kay Henry," Regan wrote. "We are ashamed and embarrassed for our Union."

But he insisted the Oakland local will keep fighting for its controversial "partnership" with the California Hospital Association, designed to help UHW recruit more members; for enhanced state funding of the Medi-Cal program for the poor, and for a $15 per hour minimum wage via a planned November 2016 ballot initiative.

Ironically, the current hostility between Oakland-based UHW and the parent union echoes a similar battle six and a half years years ago when former longtime UHW President Sal Rosselli tangled with top leaders and left to start the upstart National Union of Healthcare Workers, which has battled SEIU and UHW ever since. The union leader who replaced the fiery Rosselli: Dave Regan.

When I reached Rosselli by phone, he thoroughly enjoyed the irony of the situation, noting that Regan is now tangling with Henry over the same issue that splintered the union almost seven years ago, whether long-term-care workers are better off in UHW and other broad health care locals or in a specialized unit.

SEIU Fatcats Sue Each Other in Michigan

Two factions inside SEIU Healthcare Michigan are brawling in federal court over upcoming union elections, according to a lawsuit filed in U.S. District Court (see copy below). The SEIU officials are apparently battling over who gets to stay on the union’s payroll after the union loses 45,000 of its members.

Here’s what’s going on:

Next year, SEIU Healthcare Michigan will hold internal elections for its officers, including president, secretary-treasurer, etc. In advance of the upcoming election, one faction of the union's officials -- headed by current President Marge Faville -- is trying to amend the union's constitution so as to change the rules by which candidates can be nominated for the election.

That's how the court brawl erupted.  Faville's faction wants to conduct a mail-in vote to approve the re-written constitution. A second faction -- headed by Secretary-Treasurer Johnnie Jolliffi and Recording Secretary Sheila Guinn -- says a mail-in ballot would violate the union's constitution. According to them, the constitution strictly requires an in-person membership meeting and a two-thirds majority vote before the constitution can be altered.

Last month, the Jolliffi/Guinn faction sued Faville and SEIU Healthcare Michigan in federal court. The lawsuit seeks an injunction to block SEIU Healthcare Michigan from conducting an illegal mail-in vote. Various Purple Palace officials are named in the court action, including SEIU President Mary Kay Henry and Executive VP Kirk Adams.

Here’s an excerpt from “Jolliffi el al (Plaintiffs) vs. SEIU Healthcare Michigan (Defendants).”

The Local Union, SEIU Healthcare Michigan, is trying to amend its Constitution without following the provisions of its Constitution and Bylaws. The main purpose is to change the procedures for nominating officers to be elected to the Local... Plaintiffs have complained to both the Local Union and the International Union about this action, but have received no satisfactory response. This matter is very urgent...

Defendant is violating the Local Constitution... Defendant's actions are illegal... Defendant is violating the Labor-Management Reporting and Disclosure Act of 1959... In total disregard of the provisions of its constitution, Defendant is preventing its members from discussing at a union meeting the important matter of an amendment to the union constitution… Defendant is violating Section 301 of the Labor-Management Relations Act of 1947… Defendant is liable for a breach of contract under state law.

In order to bring this matter before the membership in the manner required by the local Constitution and Bylaws, Plaintiffs request a temporary restraining order and preliminary injunction.

So what’s fueling the bitter courtroom brawl? Apparently, the lawsuit is simply the public face of a much deeper battle for control over the rapidly dwindling membership of SEIU Healthcare Michigan. Tasty hears that the leaders of both factions -- Marge Faville, Johnnie Jolliffi and Sheila Guinn -- are all ineffective fatcats.

Faville, for example, pockets $172,000 a year from union members who mostly earn minimum wage. Do you remember SEIU’s famous slogan of “Fight for a Fair Economy?” Well, apparently the Purple Palace forgot to look in the mirror -- especially at the fact that SEIU officials are “living large” off the paychecks of impoverished workers, including the 45,000 members of SEIU Healthcare Michigan who earn only $8 an hour.

Jolliffi and Guinn are no better. Here’s what this trio of purple officials earned in 2011, according to the union’s filing with the U.S. Department of Labor. (Click on the image to enlarge it.)

Very Slow Lerner

Tasty hears that SEIU's Stephen Lerner has finally realized that his purple pals are not too keen on him. Sources tell Tasty that, several weeks ago, SEIU officials fired Lerner from his position as a top SEIU staffer and a member of SEIU's International Executive Board.

It's been a long, slow learning curve for Lerner.  In 2008, Andy Stern and Mike Fishman (President of SEIU Local 32BJ) ousted Lerner from his position as the head of SEIU's Property Services Division and demoted Lerner.

Next, Stern assigned Lerner to lead a slimy attack campaign against Sal Rosselli and California's healthcare workers after they introduced proposals to democratize SEIU during the union's 2008 convention. Lerner's nefarious role in the thuggish campaign was revealed when insiders leaked an infamous email describing the Purple Palace's efforts to either "implode" SEIU-UHW or wage an Irak-like invasion against it. The email -- from June of 2008 -- has lines like this: "Trusteeship would be difficult -- it's like Iraq, easy to get in and then a slog. Implosion would be a better outcome, but what will it take?" The leaked email snagged a whole posse of plotting SEIU staffers, including Bill Ragen, Stephen Lerner, Tom DeBruin, Kirk Adams, Denise Poloyac and attorney Edgar James.

In 2010, a demoted Lerner became the punching bag for SEIU's Scott Courtney, who'd been elevated to a top job inside the Purple Palace. Later that year, Courtney put Lerner on a month-long administrative leave for "insubordination" after Lerner refused to follow Courtney's orders.

At this point, many observers expected Lerner to catch a clue and bolt the Purple Palace with a few tattered shreds of remaining dignity. Tasty hears that Lerner planned to deliver a courageous ultimatum to SEIU's Mary Kay Henry, but as he prepared to enter Henry’s office, a pair of testicles dropped to the floor.

So… Lerner completed his month-long "time-out," and then slinked back to the Purple Palace where he worked on SEIU’s effort to co-opt the Occupy Wall Street movement.

And this brings us to the latest chapter in this pitiful saga:  Lerner's termination. Tasty hears Lerner was offed by his arch-nemesis, Scott Courtney, who seized control of Lerner's project and budget dollars.

So what's next for Lerner? Looks like he's taken a page from Stern's playbook of self-promotion. Just today, Lerner set up a Facebook page where he describes himself as "a leading critic of Wall Street bankers" and "a frequent contributor on national television and radio programs..." Sounds like Lerner will soon be competing with Andy Stern to hustle speaker fees at conferences near you!
